Scope of service
Through our site www.powerestudio.com, any Customer can buy audio products, online audio services, sound effects and music libraries.
Conclusion of the contract
By clicking on the “add to Cart” button, the Customer chooses the service or products that intends to buy. By clicking on the “checkout” button, the Customer is addressed on the page on which he will confirm his intention to buy, making payment of the services or products, using credit cards or other forms of payment indicated on the site. The purchase is subject to correctness of data related to the credit card with which the Customer make the payments. Once the Customer have clicked again on the button “Purchase”, the contract is concluded.
In order to deliver the service required the Company must receive from the Customer a real email address and all the audio material and information necessary to begin the audio master, audio mixing, audio post production or podcast editing mastering. Detailed information about the required files properties are explained at the upload pages of our website.
Payment Method
PayPal
We use PayPal to finalize and pay for your order, you will provide your credit card number, directly to PayPal. PayPal’s privacy policy will apply to the information you provide on the PayPal Web site.
The security of payments by credit card are guaranteed by Paypal. Paypal system encrypts the information to ensure the security and privacy of data entered. The security of credit card payment is guaranteed by Paypal: the management and closing of transaction takes place directly on Paypal server. This payment instrument allows the cardholder to provide sensitive data (card number, expiry date, name, etc.) directly to Paypal and not at the store or service provider that manages it. For more information about payment security, the Customer can visit the web site www.paypal.com. The Customer undertakes to notify the Company any claims of objections within 60 days from the date of the debit receipt. Failure to notify within the time limits shall result in the automatic waiver by the Customer to any dispute.
Delivering of the service
If all the conditions in “conclusion of contract” are satisfied the Company will deliver the mastering service within 2 working day for each song purchased (e.g. if the Customer purchased the mastering service for 3 songs, the service will be delivered within 6 working days). The mixing service and the stem mastering service will be delivered within 3 working days for each song purchased. The post production service will be delivered in function of time of the clips and complexity of the video or type of production. POWER ESTUDIO S.L. will inform to customer the time of delivering after knowing the type and quantity of the hired job.(e.g. a promo or spot of 30″ have a job about two hours). Podcast editing mastering service will be delivered in 2 days for every podcast of 30 minutes or less.
Working days only, Saturday and Sunday is closed.
The Company can delay more days due to failure equipment or drawbacks production. When this happens customers will be informed.
Delivery of goods
Deliveries are calculated on shipping checkout. Additional customs duties and charges for deliveries from Powerestudio to countries outside the EU (third countries) shall be borne by the customer. Goods with any damage on the transportation will be replaced free of charge.
Digital products
All sound effects and music libraries purchase here entitle you as a single user.
All samples are Royalty-free.
You can use this library for your personal or commercial use.
Resale, copy and other distribution of these sound samples it´s forbidden.
Our sound effects and music libraries are downloadable only. The devolution of audio libraries is not allowed unless the website notifies otherwise.
Free demonstrations
Powerestudio SL reserves the right to cancel, terminate, or not
perform free demonstrations if for any reason at this entity will
consider that is necessary.
Prices
Prices are those indicated on the site at the time of placing the order and the taxes are excluded. The prices on the site are editable at any time, without notice.
Taxes (European customers only)
Products and services are showed without 21% VAT. European customers with a valid VAT ID do not pay tax.
Damaged Packages
If your package is damaged, you MUST contact within 7 days from delivery. Email info@powerestudio.com
Shipping Cost
Shipping and insurance costs are non-refundable.
Right of withdrawal (Services)
After the purchase of the services by the Customer, the Company sends the Customer an email containing a link to download the finished work. Once services are finished and customer has received the downloadable link is not granted the exercise the right to withdraw from the contract. So, the Company shall refund the Customer only until the final work file has not been sent to the Customer via any suitable online transfer method. The customer has 14 days before the termination of service.
Digital download products don´t have right of withdrawal because downloadable products cannot be returned.
Right of withdrawal (Goods)
Customer have 14 days to withdraw all goods (except digital downloads).
After inspection of goods the amount will be refunded to the customer.
Exclusions from the statutory right of withdrawal
Goods with clear signs of damage by the use of the customer or goods missing items and not complete, will not be refunded.

All files and data user will be send through our website, www.wetranfer.com or www.sharesend.com

Downloading problems
For any problem in downloading the files from the link provided, the Customer must contact the Company and open a separate request. Such notification shall, reach the Company without delay, and in any event within eight days from the download.
Liability
The service is provided on ‘AS IS’ basis, without warranty of any kind and its functionality is subject to proper use by the Customer. The company be liable for delays or inefficiency only in case of intent or gross negligence directly attributable to the Company. The Company disclaims all warranties, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose and perfect functioning of the service. The entire risk arising out of use of the service is at Customer’s charge. In no event shall the Company be liable for consequential, incidental, indirect or other damages of any kind, including but not limited to damages caused by a missed economic profit, interruption of business, computer shutdown, damage to hardware or software, loss of information or data, or any other damage incurred by the Customer in connection with the use, or the inability to use, the service, even if the Company had been advised about the possibility of such damages. The Company will not be liable, under any circumstances, the material to which the Customer has had access through the service.
All files and data provided by the customer are of their owned as well as liability of copyright or legal rights.
Powerestudio SL ensures all files and data will be used only for audio services jobs. They will be stored confidentially and will be erased after one month of the finishing of the service.
Credits
We hereby give you permission and you agree to include the following credit in relation to any CD or other record that has been mastered or mixed by www.powerestudio.com .Service and released to the public by you: – “Mastered and/or Mixed by www.powerestudio.com”
Customers obligations
The Customer may not use the audio services in a way that make infringement of intellectual property rights of the authors of songs, producers and other owners of the rights to the songs. The Customer undertakes not to use the Service in a manner contrary to netiquette, not to carry out spam and not cause, however, any disturbance to third parties. The Customer undertakes to indemnify the Company from cost, damage or expense arising from the use of the Service in a different way from this Agreement. The service is protected by applicable laws on copyright and intellectual property. Customer agrees to indemnify the Company from any loss, damage, liability or expense whatsoever relating to complaints against the user due to the fact that he has used in any way materials or products in connection with the Service in violation of any applicable law, third party rights or the terms of the contract.
Conservation of the Terms of Service
To use the Service, the Customer have to carefully read these Terms and Conditions of Service: use of the Service by the Customer therefore implies full knowledge and full acceptance of the same. The Customer undertakes, once completed the procedure to use the Service online, to keep these conditions of sale, in order to fully satisfy the provisions of EU rules (directive 2011/83).
